I have re-discovered the creative side in me. Drawing and painting for pleasure inspires a self-confidence that needs to be exploited. The sale of 6 paintings in a fortnight has confirmed my talent.   • Legal advice please re rent arrears and counter claim?

    I have been to Court today on a possession and rent arrears hearing. The Judge Ordered no claim re possession as the Defendant already had possession of the property. In respect of the rent arrears the Judge ordered that "the Claim do proceed if brought pursuant to CPR part 7 as monetary claim for above rent arrears" We are also to deliver to court before 4pm on 14th January 2011 to both the Court and the Claimant a defence to the claim and counter claim in respect of monies owed to us.

    What I would like to know does the Claimant now need to issue new proceedings under CPR part 7? If so, what is the time scale involved bearing in mind we need to serve a defence before 14th January.

    Also what happens if she does not serve new claim can we sue her for the counter claim and the monies she owes us.

    Any advice would be appreciated thank you

  • I hae moved out of my rent house and the landlord has now served Court papers for eviction and arrears of rent?

    . However she has served them on me at the property address (where she now lives) and I believe she has hand delivered them to ensure they are received. I am confused as she has addressed them to me at the property which I no longer live in. She has also stated there are arrears of £1,950 but to my recollection it is only £800.00. Furthermore she has never returned my deposit or rent paid in advance. I also believe that she did not protect the deposit in the correct manner. I believe that as she nows lives in the house, then the application for possession is nonsensical. Should she not go through the monetry judgement route for the arrears of rent ? any advice would be greatly received. FJ

  • What is wrong with my 7 month old son through the night?

    Since my son was newborn he has never slept enough for what a baby really should do, every time he started to actually sleep for a couple of hours he always woke up and his eyes were wide open as if he had never been asleep. He started to sleep on the couch a little as he would never go in his cot. As soon as id put him in he would wake up straight away. As hes getting older he is getting worse he now doesn't even sleep in the bed with me or anything he just cries all night especially if i leave the room, iv tried everything, leaving him to cry, moved him into his own room so i don't disturb him, putting rice in his bottles in case he is very hungry, tried the light on/off, TV on/off absolutely everything, I really need help i cant live like this anymore i need to sleep.. Does anyone have any answers for me i would really appreciate it..

  • I'm frightened!. Not supported by my team.?

    As an agency worker, in a children's unit, I was involved with 3 teens, trying to break into the unit and attack a 15 year old pregnant girl.

    I went to the door to block their aggressive onslaught. A male member of staff intervened, telling me it would be wise to let them in!, preventing any damage or injury to myself or the unit.

    I refused his spineless request.

    I stood firm at the door whilst 5, female members of staff sat inside. The door was locked, stopping them getting in, or me needing assistance.

    One of them pulled a knife on me and ordered me to get out of the way. I had nowhere to go. I told him to give it his best shot, otherwise I would drop him. He teased, started laughing and pretended to stab me.

    I was then warned, by the spineless get!, that I had inflamed the situation by encouraging him to attack. He said this from the safety of the office.

    What are we dealing with today?.

    I know these children represent just 2% of the child population, but appeasement will never work.

    Or will it?.

  • I downloaded the latest version of Spybot search and destroy 1.6.?

    Now every time I click on the short cut, I have to go through the Install procedure. Each step is the same as the initial download. It hasn't found anything in over a week - Brilliant! - but CA yahoo anti-spy has found,

    and ProKill.

    Am I in danger losing any data or under threat?. What is the likely outcome of these so called Trojans, as they are classed?.

    I have just started to use Mozilla Firefox

    I also have to redesign my 'Yahoo Protect-login seal' each time I log-on!.
