  • Benami Property and HUF - India?

My grand father, a farmer with ancestral land bought some more land which he bought in the name of one of his minor grandsons, with the grandfather himself as the guardian (waldi of the minor). We were not even born then. Now the grandson is saying he has full rights over the property. How does the Benami property (prohibition) act apply in this case considering that the property should be HUF property?

  • Is Darjeeling worth it after sikkim?

Is Darjeeling worth a visit? A friend of mine who ives in Sikkim advises that after visiting Sikkim Darjeeling has nothing to offer other than concrete jungle. He says that only toy train (for its "touristy" value) and the zoo (for its captive "snow leopard" and "red panda") is what Darjeeling has to offer. If its tea garden then that too you can get one in sikkim and darjeeling need not be in the itinerary. Need a second opinion, since I don't want to give in to his bias as he lives in sikkim.

  • My wife is seeking divorce from me. She wants a mutual consent divorce.?

I and my wife both are Indian citizens living in India. We have a 9 month old daughter. She moved to Delhi about 2 month back. I was OK with mutual consent divorce and willing for her having the custody (the child is too young) since I wanted it to be amicable. But in last one month my wife's attitude is changing. She is no longer involving me with my daughter, nor does she tell me about my daughter at all. She has already made strange allegations about me to her sister and brother stating I was abusive towards her etc. This is neither true nor I had imagined that our relationship would end this way. Should I not accept her ask of mutual consent divorce. How soon will I get defined visitation rights. She allows me to visit once a fortnight for weekends. Is there any chance of me getting the child's custody. My wife is not a bad mother (not the best mother as well). But I need to have some connect with my daughter and some say in what she grows up as.
