  • chapter 13 bankruptcy?

    If I owe over $250k in IRS back tax how can i possibly pay that off in Chapter 13 plan - our net monthly income is $7204 - plus we have about 50,000 in student loans and about 20k in unsecured debts.

    Is there an alternative to chapter 13?

  • IRS wage Levy question -?

    currently have a wage levy for $1350 per pay check leaving me with $600 per check to live off of - I get paid every two weeks. I am am being levied because i am the higher wage earner - ex has no levy on wages currently. Now my issue is the national allowable IRS standards say I am allowed:

    $1053 for food, clothing, supplies, misc

    $120 for health care

    $1804 for housing and utilities

    $664 for transportation

    $3641/month

    Obviously with the current levy i am only netting $1200 -

    so my main questions is once the divorce is finalized will the IRS lower the levy amount to allow me the National Standard Expenses? or am I expected to live and support my child on the $1200 i current have?

    Any advice is appreciated - thank you all for taking the time to provide any answers -

  • Clarification to my past question about IRS Garnishment and OIC?

    Thank you to all who replied to my previous post - I think I need to clarify the situation.

    Facts: Married (currently) and have a current wage garnishment agreement with the IRS. My pay is being garnished as I make the higher wage. Our Garnishment amount was determined by IRS Agent using the National Allowable expense figures (for the most part). This was established as married couple with both incomes considered. Now here is what I am assuming will happen once the divorce is settled - The IRS will now assess each of us individually for a payment agreement based on each income and Allowable Expenses. My big assumption is that once this is done they will stop the current garnishment on my wages and apply a revised one based on the new living/income situation (reducing the garnishment significantly). Because the household income will be reduced significantly and the balance owed is VERY substantial that i may qualify for an OIC but how does that work when the responsible parties are no longer together? do we each have to do an OIC? Will the accept 2 OIC towards the same balance?

  • IRS garnishment vs the IRS allowable expenses?

    My husband and I are divorcing - currently we owe a substantial amount in back taxes. My wages are currently being garnished. My questions is the IRS has a National Standards for allowances per month - which comes to about $3641 for living in my situation but the wage garnishment table says my wage garnishment exemption is only $1058.62 - so which do i need to use?

  • Owe back taxes but getting a divorce -?

    My wife an i owe over $100,000 in back taxes - currently the IRS is garnishing her paycheck for the repayment. Sadly we are getting divorced - what happens to the back tax amount (we agree to share ownership of the amount owed 50/50) ? and will this change her garnishment so she has money to live on?
