Can I revert to my maiden name when I renew my British passport, even though I'm still married?

I never wanted to use my married name, but my husband filled the forms on my first passport. It has given no end of trouble since I don't use his name in any other document. How could I change it to my maiden name?

    You do not have any 'official' name in English Law: you can call yourself anything you like. However, some institutions like the Passport Authority require evidence of your name. You should just be able to fill in a form for a replacement Passport stating your maiden name and providing some evidence of this name, such as your birth certificate.

    The Passport Authority can be funny about this though and, if they are, they are likely to want a Change of Name Deed to prove the change back to your maiden name. A solicitor can prepare this for you for about £50.

    You can call yourself anything you want to be as long as it is not for illegal purposes. You state that you do not use it for any other business. Does that mean your bank and other serviced are in your maiden name? 1) You can get a name change by deed poll through a solicitor. This will cost you or 2) You can notify all relevant people that you wish to be named by your maiden name in the future. You will have to give proof to the passport office that you are known by your maiden name on other things etc.

    As already stated you can use any name you wish for legitimate purposes. Many married women retain their maiden surname for professional reasons. All you need to do is fill in the passport form with your maiden name stating that you wish to be known by that name and include some identification in that name - birth certificate or driving license etc. Good luck.

    As you never used your married name befoire and can prove it with other paper work (National insurance number/Driving licence etc) you can use that to back up your argument that your passport should never have been issued in your husband's name in a first place. When applying to get your passport renewed, explain what happened and join other paperwork as proof. You can slo write an afidavit, get it witnessed by a solicitor or, if in Scotland visit your JP who will do it for free.

    You can call yourself anything you want to as long as it is not for fraudulent purposes. So when you renew your passport you can use your maiden name. Stating on the passport form that what was your married name

    See a lawyer It is illegal for a husband to sign a legal document for a wife.If you had nothing to do with the passport application it is fraud. Serious crime
