My Mother passed away just a few weeks ago and I was wondering if My Sister and I have rights to her things?

my Mother left no will for anyone, she was only 39, so of course she didn't have a will, but her husband was my step father but no longer of course, he is claiming that he has all of the rights to her things and that my sister and I are not going to get anything because everything is in his house. So does my sister and I have rights to her things since she was our mother? I am only 18 so I don't no what to do in a situation like this. So please tell me if you know if there are any rights that My sister and I have. Thank You!

    It's very childish that he's acting that way. But, since you are 18 you have some legal pull if you wanted to push anything. Try talking to a lawyer.

    This is really a legal forum question, but in general, when a spouse dies without a will, her estate goes to the surviving spouse. So your stepfather is right, legally the property belongs to him.

    If she was married to your step father at the time of her death then HE has rights to her entire estate.

    You and your sister should get it. If he begins taking the belongings, you can get a solicitor to sort it out for you. Don't let him simply take your mum's stuff.
