He WAS ARMED up until seconds before he was shot! The LEO may not have seen the CRIMINAL discard his firearm and the LEO was reacting properly to a person he/she KNEW was armed SECONDS prior to shooting the criminal!! Just because the ARMED CRIMINAL suddenly does NOT have they're firearm in they're hand a SECOND to SECONDS prior to FINALLY surrendering to the LEO'S does NOT negate the FACT that the criminal was in fact KNOWN to be ARMED by the LEO'S and could have STILL had they're firearm or ANOTHER firearm in an EASILY accessible place and be ready to shoot the LEO the moment they lower they're firearm!!!
