  • child custody and immigration questions?

    My friend entered US via J-1 Visa(Aupair) in August 2000. She met her US citizen husband couple months before her visa's ended. He got her pregnant so he told her to stay here and promise to marry her. They didn't get married until her son was 1.5 yrs. old so she was overstayed and her visa was out of status by then. He never tried to get my friend legallized by getting her "green card" and she couldn't do anything about it since she didn't have money to pay for the fees. She's forced to be a stay at home mom since she's illegal to work and he never give her money. Now they have 2 more kids(3 total) and she's still "illegal" and not having green card. She couldn't go back to her country because he threat to take the kids away. She's recently just have enough saving money to file for green card application. It's still processing but she's not sure if the INS will grant her green card since she's been out of status for so long. She doesn't card about the outcome of the green card process any more since she's really fed up with her husband abusive(verbally) toward her and the kids. He calls her "freeloader" since she couldn't help him out financially but how could she go to work since she's "illegal". He's also very insecure and always think that she's cheating on him though she never goes out without taking her kids along. He never helps out with taking care of the kids since they were born. She wants to leave him but she's afraid of losing her kids due to her legal situation. She doesn't care about child support or any financial support from him. All she wants is to be able to keep the kids and take them back to her country. She doesn't want to live here any more since she couldn't work and has no right to do anything here.

    Will she get child custody if she files for divorce?

    If she get deported will she be able to take her kids along?

  • Is it rude to ask why my client didn't give me holiday money this year?

    I have my own cleaning business for 4 yrs. now. I work for this family for 3 yrs. and they always tip me for the past 2 yrs. However, this year they didn't tip me yet and I won't be back to their house until after New Year. I don't think they have money problem since I also clean their office and noticed that they gave their employee bonus for holidays. They're very nice family and I don't know why they didn't give me anything this year. They're very good tipper so it'll be a big lost if I don't get their holiday money this year.

    Should I ask why they don't give me holiday money? Is it rude? I don't care much about money(eventhough it's a lot) but I just want to know if I did anything wrong which made them decided to not give me holiday money so I can improve my work. Please advice.

  • What type of lawyer that I need to file lawsuit against my immigration attorney?

    I came here with J-1 visa with 2 yrs. home country which need to be waived before I can file for green card. I've hired an immigration lawyer to work on my green card and waiver cases. The lawyer told me to go ahead and file for waiver and green card at the same time. I had no knowledge about the procedure so I went along. I went in for my green card interview and had to withdraw my green card application since I need to have the waiver approval before apply for green card. Also, the lawyer told me to use Hardship reason for waiver instead of get No Objection letter from my embassy which is quicker and easier. I paid $2,500 legal fees for green card and waiver applications plus application fees. After my green card application's withdrawn the lawyer refused to work on my waiver application and said that he needs me to pay $1,000 more. Also, the INS has told me that the separation of the family is not consider as Hardship. I decided to get No Objection letter from my embassy myself last month. It only took 4 weeks to get the letter and now I got the approval for No Objection from my embassy.

    I need to file lawsuit to get my money back since the lawyer didn't do his job right which cause me time and money. Now I have to start my green card application over again if I got the approval from Department of State for my waiver.

    Please advice what kind of lawyer I need to get to handle this lawsuit.

  • insufficient fund and return check fees?

    I banked with Provident bank for about 4 yrs and never had problem with overdraft fees until they merged with M&T bank. I've been charged over $350 for insufficient fund fees because the bank held the checks that I deposited for couple days. I didn't know that so paid bills online like I usually did when I banked with Provident bank. I'm so pissed and seemed to me that I deposit money to pay the overdreaft fees so the bank can keep charging me more fees. I'm a single mom and really can't afford these B-ll Sh-t fees. However, they creditted me couple of the fees back but still continue to charge the fees. What's the sense in that? Should I just stop deposit the money and open another account with new bank? I might have to do that even though I hate to be irresposible person.

    Then they decided to let one of my credit card payment go through so they can charged me $37 fee then reverse the payment back to my bank account. Now I ended up with $39 return check fee and $39 late payment fee from my credit card plus $37 overdraft fee from the bank. I don't get it, I deposited checks in on Friday same day as the credit card payment came in. Obviously, the checks didn't clear until Monday but why the dawn bank let the payment went through then reverse it. Who's at fault? Am I eligible to get the return check fee and late payment fee or at least one of them back from my credit card company? Please help!!!

  • immigration question?

    My friend's entered U.S in Aug 2000 with J-1 visa through Au Pair program. She had problem get along with the host family after about 2 months and the program refused to rematch her to the new family and tried to send her back home. She decided to run away from the program and has a child with U.S citizen but didn't get married until July 2003. Her visa expired on Sep 2001 and she has 2 yrs rule home country condition on her visa as well. She tried to apply for green card on April 2004 but INS refused to grant her green card until her waiver is approved. The INS said that the separation from husband and child is not good enough for HARDSHIP. So they send my case to Department of Homeland Security and asked her to start everything all over again. My friend is now pregnant with her second child and will give birth in Jan 2008. She's afraid of getting deportation since she didn't complete the Au Pair program. Please advice

  • jury duty problem?

    My friend who entered the U.S legally 7 yrs ago has let her visa expired just recently got married with U.S citizen and still in process of filing for permanent resident card. However, she just got jury duty paper from the court. She replied them that she's not U.S citizen but they want some type of papers to show her legal status in U.S.A. She's talked to the immigration lawyer because she's afraid to get in trouble with the court(she has 1 U.S born child and now pregnant with another child). The lawyer told her that it won't be any problems because she's not U.S citizen. Please suggest what she should do.

  • not at fault accident?

    I had an accident last December. The other car hit me in the back of driver side. I swear to God that he ran the red light and hit me. It was my first accident so I had no idea what to do. Somehow he got a witness to give the cops statement saying that she saw me ran the red light and cause the other guys to hit me. I didn't get to find any witnesses for me because I knew that I wasn't at fault but I was wrong. The cop believed her lie and gave me citation for ran the red light. I went to the court and was so surprise to see the witness there. I swear I never saw her at the accident scene. I couldn't believe my ears when I heard what she told the judge. Thanks God, the judge didn't believe her BS and found me not guilty for my citation. However, my insurance company had put the liability on me because of the police report and the statement from the witness. Now I'm stuck with rate increasing and at fault accident on my driving record. Can I do anything about it?

  • Speaker's not working?

    I have Logitech speaker and it's been working good for me until my husband played around with my computer. I've tried to change setting but it won't work, I also try to hook the speaker from my monitor to the computer but still won't work. My husband thought that I need new sound card so he bought ones last night but it still won't work. Can you tell what is/are the problem(s)?

    I deleted the e-mail from Yahoo inbox sometimes last week. It's usually stored in trash box but it emptied itself up automaticly and now I need to get the one e-mail back. Does anybody know how to get it back? or it's just hopeless.

    My husband is a Jerk!!! He took the hard drive out of my PC which I found very rude and unrespectful. He's suspiciuos that I'm cheating on him with some guys online because I've spent a lot of time on my PC. I have to admit that I spend a lot of time on my PC but only to do my work and entertaining. I don't do no chating or seeking for some other guys. So, my question is can my husband tracks down any infos that I've been through on the internet of off my PC? I don't keep track of the web sites I was on because my PC cleared up the history every time I'm online. I don't worry about what he'll find because it'll be nothing. Just curious.

  • Can you tell if my boy friend is cheating?

    I have a boy friend who has a fantasy of threesome relationship. He also likes to watch porn. I have suspicious about him cheating on me so I looked on his cellphone message records. I found couple girls sent him messages that were not usual friend relationship. I think he problably had sex with them too because I found used condom in the trash bag but when I convinced him he said that he put it on when he was masterbating himself. I don't think it makes sense cause why do you need to put condom on when you masterbate? I want to break up with him but for some reasons I just can't get over him.
