How long does it take to get taxes taken for back owed child support?

My husbands ex-wife had her income tax refund taken for back owed child-support. How long does it take for before he gets it?

    It can take up to 6 months as FMS will sit on it to allow her current spouse, if she has one, time to file an Injured Spouse claim. FMS has no way of knowing what her filing status is, and the IRS can't tell them what it is so there's no way to expedite it in most cases.

    In Ohio, the money is released to the Child Support Enforcement Agency and they are the ones that hold it for 6 months (if it was taken from a joint return). If she filed single or married filing separately, it will go to the CSEA and they will apply it to the arrearages and release it as they would any other payment coming in (usually within a few days). If she did file married filing jointly, she can have her spouse sign a form available from the CSEA stating that he will not pursue Injured Spouse and the funds can be released right away as well. Unless the spouse has a significant claim, it would be in her best interest to have the money released right away instead of waiting for Injured Spouse to be claimed as she will continue to be in arrears and they could possibly continue more strict collection methods (such as taking away her driver's license or even jail). I have been on both sides of this situation...my ex-husband is arrears on his child support and has been for a couple of years, and my current husband was in arrears last year due to job loss and we had our taxes offset. My Injured Spouse claim was minimal so I signed that paper, got his arrears paid and now we are back on track! Good luck!!
