Can I use a photo of me owned by someone else?

Someone took a bunch of photos of me and my horse, they are quality photos and they are for sale. I was tagged in all of them. She is selling them digital or printed copies. Can I use it for my profile picture or would that be rude? They are not copyrighted or anything, and although I saved all of them I just feel rude using it when I have not paid for it.

Sorry, I mean use it on facebook or the internet in general.

    You might want to talk to a lawyer.

    Depending on where you are located...If either you and/or your horse are identifiable and she did NOT have you sign a model release for your image and a property release for the horses' image (just like if you take a photo of a cow and the ear tag is readable, you should get a property release from the owner if you plan on selling the image) and offer you compensation, then she should NOT be selling them.

    B I E is right if you didn't sign a release, the photographer has no right to be selling pictures of you. Therefore I'm sure they would be happy to let you use it, rather than sue them.
