is driving a forklift drunk a DUI offence in ONtario Canada?

I am wondering if driving a FORKLIFT under the influence is a CHARGABLE offence in ONTARIO or if its just handled by the labor board of Ontario. Or is it only a crime if the vehicle is driven in public road.

I was wondering because I think some of our drivers come in rather intoxicated..by the odor.

That's DUI. Even if he was driving on his own property.

In most cases the law specifies that a DUI offense can only be charged for operating a motor vehicle on a public roadway.

Forklift on a public roadway, yes it is probably chargeable as DUI. Forklift in a warehouse, not on a public roadway, therefore not chargeable as a DUI. However ... being on company property during work hours while intoxicated is probably a violation of company policy, and should be an offense carrying the penalty of immediate discharge from employment.

If anyone is caught driving erratically on anything, the police can pull you over. Even a lawn mower.
