Restaurant refusing to serve us?

We live next to a small pub/restaurant. We worked late today, and got home around 7:30pm. We walked over to the restaurant at 8:30, I did not drink anything prior to going there, and my partner had one beer. We went into the lounge and the waitress said "you both look intoxicated. I cannot serve you". I don't even know how she could have made that judgment but clearly I was upset. She walked away, and after a few minutes of not hearing back from her we asked if could have a food menu. She have a dirty look and said "I cannot serve you. You need to leave". I asked to speak to manager who was in the restaurant area at the front desk. He basically had nothing to say and shrugged his shoulders. I am typing this now 100% sober, I don't understand how on earth they could accuse us of being drunk. Not to mention this is wrong? Is it not? To refuse us from even ordering a pizza. I am so upset with this place, and I wrote them a stern email. Is there anything I can do? Can I hold anything against them or should I just let it go? (May I add that we were celebrating a birthday) and ended up going home. I just hate places like this. Just because it is saturday night it does not mean we are shiitfaced young adults.

    Well Max I'm a veteran Liquor License Issuer(see I can make up lies too). Anywhere that has a liquor license isn't allowed to serve liquor to ANYONE they believe is visibly intoxicated. MOST places won't serve the person at all because that way you weren't a customer of the business if you do anything stupid. I mean you could argue you went there, and they will say that they didn't serve you anything. Perhaps it was working late you looked tired and the waitress thought you looked drunk, who knows. However they had the right to deny you service and if you don't like what happened then simply exercise your right not to go back there again.

    People leave places and have car accidents. They are asked where they came from and where they were having their drinks. The next thing; the establishment is involved for serving them. If they suspect in anyway that you shouldn't be served; they will not serve you. That is the bottom line. I saw an establishment brought to court. They had to spend a great deal of money to find out that the drunk driver had left their bar and was drinking at a another bar before having the accident. It's unpleasant but they have reasons. They are liable.

    Restaurants are private businesses, and they can legally refuse service to anyone, for any reason.

    Obviously the server was a bad judge of intoxication, but the only thing you can really do is file a complaint with the owner. There isn't any legal recourse.

    Well, to begin with, I wish I could tell you to retract that e-mail, because if you were to sue them, anything in it could be used against you. What you need to find out is if they have a specific policy concerning intox. level in their establishment. Next, decide how specific it is and if it would be wise to press this in court or if you should just avoid that restaurant in the future, and put the incident behind you. If you do think that it is worth the expenses of a lawyer and court costs and etc., then proceed, but absolutely be sure and do not defame them in any way on any social media site or sites that allow you to submit reviews based on your experience, because they can sue you for that, and if you have, and you wish to proceed to court, I suggest you remove them promptly.     You have no complaint, the business has the right to refuse service to anybody as long as it did not involve, race, age,sex or handicap, you do not fall under any of those

    You have no complaint under any state or federal laws, get over yourself and find another place

  • Every restaurant has a basically unrestricted right to refuse service to anyone. If they feel that you are intoxicated, they have the DUTY to refuse to sell you any more alcohol (it is set out in their liquor license).

    Feel free to ***** to the store management, but that's your only place to complain.

    They are in business because they offer a good service to paying customers. You can admit you were a bad customer, and try it again, or you can stop paying and go somewhere else to eat...and pay.

    If you can find a place online to give them a negative review, you can do that. You could report them to the BBB. But that really is it. They are a private establishment and can refuse service to anyone.

    you need to let it go. they are a private establishment--they have "the right to refuse service to anyone for any reason"

    They didn't legally do anything wrong. You already emailed them to complain and that's about as much as you can do.
