I'm a uk citizen in america and have married a us citizen, how can i adjust my status?
i came here in the visa wavier program and married my fiancee who is a us citizen i want to stay here so i want to adjust my status to permanent resident, but i don't know what forms to fill out or how much it will cost, or where to do this any help on about doing this process would be great and can i stay even thought the forms are being processed and goes over the departure date that I'm supposed to leave on

Its a long process. I'd start with a very good lawyer. I find it amazing how many people jump into marriage and have no idea how what they need to do to become a citizen/legal, in order to stay with their spouse! I am sure there are plenty that apply, but are not eligible whether its a criminal past or whatever. Just seems to me, to be one of the most important things one needs to know, so when they say "yes", both know what road they are going down.

You may have a long road ahead of you. You entered on the VWP and then turned around ang got married - a BIG no no with immigration! VWP is for temporary visits to the US, I am sure if immigration asked you the purpose of your visit, you didn't say to marry an American Citizen, in that case I doubt you would have been admitted. On the immigration form you have to say what your immigrant status was before the marriage so that you can adjust it, you didn't have status - you weren't here working, and from the sounds of it you didn't bother to apply for a Fiancee visa to enter the country. In most cases you can file all the forms yourself, they are pretty straight forward as long as you are organized and keep track of all your paperwork, but as your case already has a stike against it I would suggest at lease consulting with an attorney, I may be wrong, but to my knowledge you need a visa before you can adjust status. First thing to do is go to the ins office and ask for the form and they will give you a fee sheet in the package. After so, sit on a quiet day with your fiancee and put pen to paper. It's so easy I did it myself. They change the fee so often and if you send the wrong fee it with delay your filling. Don't forget to file the i765 for work permit, where you acn obtain a social to work, get bank account, drivier license, credit cards and whatever else you need. Good luck. Don't use a lawyer. Source(s): Don't let people discourage you, this something i resent do nmyself. Are you a criminal? did you do a business mariage? the only thing can happen is they would ask that you go back to uk to obtain your green card. You enter using a visa, what make you a criminal? why would your husband as a us citizen be treated differently from other citizen. All i use was some common sense in my filing, not a layer and i got a 10 years green card not a 3 or 2 years like some people did. your doing nothing wrong. stop let people discourage you and start your filing i find it easy. If your married truefully you have nothing to worry about, unless you or your husband do a few crime, he dont work enough money, have some kind of disease or stupid. - CherryLv 41 decade ago
You need to apply for the I130 and I 485 Applications together, for the I-130 is $355 and the I-485 $930 plus a biometrics fee of $80; the fee total is $1,010. This is going to be a long process i would say first step is to get yourself a lawyer and a good immigration lawyer .Good luck hope everythng works out .
