Who can be a trustee ?

After my mother died, I had to put the money I inherited from her into a trust fund so I could receive Social Security Disability  ( Don't judge me ) . After my brother died in 2003, I was able to buy a condo . The lawyer who settled my brother’s estate put my condo in my trust fund’s name . The trustees I have now are going too far and overstepping their authority and they insisted I move out of my condo so they could sell it . I absolutely hate moving, and I want to live in the same house on the same street in the same town until the day I die ! I want to replace my trustees . My current trustees are the only trustee service in town . My friend Marcia believes only another trustee service can take over . When I set up this trust fund, my lawyer asked me “Do you want your brother or your father to be your trustee ?” . My therapist said he used to be a trustee for one of his relatives . There are 28,190 people in my town . Do you mean to tell me in all those people, nobody can replace my trustees ?

Update:

I’ve covered this subject on "Yahoo ! Answers" before, and one person said “Just about any competent adult could be a trustee .” . Another person said “A trustee can be anybody you choose . There are no restrictions for a trustee to a trust to be a family member or not .” .

Update 2:

Were they wrong ? My new trustee has to be an honest person and he ( or she ) has to believe that I should live in my condo until I die . Is there a law that says only a trustee service can be a trustee ? Thank you in advance for your answers .

Social Security Disability in not income based.  So there must be something else going on that you were not able to manage the money instead of having the trust fund= are you on SSI not SSDI?  Did your mom specify that the money needed to go to a special needs trust and not to you?

We have no idea what is going on and why you are unable to manage your own trust...

Normally, anyone can manage a trust.  Your friend (although I wouldn't select a friend), any lawyer or accountant, etc.

However, if it's a special needs trust, it has different requirements and due to the complexity usually a professional administrator is needed to administrator the trust.

It's unlikely that you need a trustee that is in your city.

You say you have been evicted from you condo.  What was the cause of the eviction?  Failure to follow the rules?  Don't have funds for upkeep?

You can pick a Trustee from any City in the World. It does not have to be in your town.
